Terms of Use

Effective date: September 29, 2026

These Terms of Use (“Terms”) govern access to and use of the public website at digitalxc.com and its pages (the “Website”). The Website is operated by DigitalXC Inc., a Delaware corporation (“DigitalXC,” “we,” or “us”). Contact us at legal@digitalxc.com with questions about these Terms.

These Terms govern the public Website only. A subscription, trial, demonstration environment, support service, software product, or other service provided by DigitalXC is governed by its separate written agreement, if any. If a separate written agreement conflicts with these Terms for that service, the separate agreement controls.

1. Use of the Website

You may use the Website for lawful business or personal information purposes. You must not interfere with its operation or security; attempt unauthorized access to accounts, systems, or data; introduce malicious code; scrape or use automated tools in a way that burdens the Website or violates applicable law; or use Website content to infringe another person’s rights.

We may restrict access to the Website when reasonably necessary to protect the Website, its users, or our rights.

2. Information and product descriptions

The Website provides general information about DigitalXC and its products and services. We work to keep it accurate, but features, availability, pricing, and descriptions may change. Website content is not a binding offer or a promise that a particular feature or service will be available. A request for a demonstration, a contact form submission, or a conversation with a chatbot does not create a customer agreement.

3. AI and chatbot content

If the Website offers an AI-powered chat or similar feature, its responses may be incomplete or inaccurate. Do not rely on those responses as legal, financial, medical, security, or other professional advice, or as a commitment by DigitalXC. Please confirm material product or commercial details with a DigitalXC representative.

Do not submit passwords, payment information, sensitive personal information, or confidential business information through a public Website chat or form unless the form specifically requests it and you are authorized to share it.

4. Intellectual property

The Website and its content, including text, design, graphics, logos, software, and other materials, are owned by DigitalXC or its licensors and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, revocable permission to view the Website and to use reasonable excerpts for your own internal evaluation of DigitalXC, provided you keep any attribution and proprietary notices. No other license or right is granted by these Terms.

DigitalXC names, logos, and product names may not be used in a way that suggests endorsement or affiliation without our written permission.

5. Content you send us

If you send us an inquiry, feedback, or other material through the Website, you represent that you have the right to submit it. You give DigitalXC permission to use it to respond to you, operate and improve the Website, and evaluate or provide the products and services you ask about, subject to our Privacy Policy and any applicable separate agreement. You retain ownership of your material. Please do not submit ideas or materials that you expect us to treat as confidential unless we have agreed in writing to do so.

6. Privacy and third-party websites

Our Privacy Policy explains how we handle personal information collected through the Website. The Website may link to third-party websites or tools. We do not control them, and their own terms and privacy practices apply.

7. Availability and disclaimers

We may change, suspend, or discontinue any part of the Website. To the extent permitted by applicable law, the Website is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. Nothing in these Terms excludes a warranty that cannot legally be excluded.

8. Limitation of liability

To the extent permitted by applicable law, DigitalXC and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Website. Our total liability for claims arising from the Website under these Terms will not exceed US $100. These limits do not apply where applicable law prohibits them, or to liability that cannot legally be limited.

9. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Subject to any mandatory law that applies to you, disputes relating to these Terms or the Website will be brought in the state or federal courts located in Delaware, and each party consents to those courts’ jurisdiction.

10. Changes to these Terms

We may update these Terms by posting a revised version on this page with a new effective date. Changes apply from the date posted. If you continue to use the Website after a change takes effect, the updated Terms govern that use.
